GENERAL TERMS AND CONDITIONS OF SALE OF TEXTRADE KFT.

These General Terms and Conditions (hereinafter referred to as the “GTC”) apply to all contracts of sale concluded by TEXTRADE Kft. (registered seat: 8043 Iszkaszentgyörgy, Városkapu Üzletház, hrsz. 622/1., company registration number: 07-09-013750, tax number: 14119888-2-07; hereinafter referred to as the “Seller”) in connection with the sale of goods referred to as “Darálék / Shred” (hereinafter referred to as „Goods”.)

  1. All such contracts of sale shall be governed by the provisions of Act V of 2013 on the Civil Code of Hungary, as well as by the terms and conditions set forth herein.

These GTC shall constitute an integral and inseparable part of every contract of sale entered into between the Seller and the Buyer.

  1. 1. Definitions
    For the purposes of these GTC:
    1. “Contract of Sale” means any agreement concluded between the Seller and the Buyer for the sale and purchase of the Goods.
    Such contract is formed by a verbal offer made by telephone, specifying the quantity, purchase price, and delivery date of the Goods, and by the Buyer’s acceptance thereof through payment of the amount indicated in the pro forma invoice issued by the Seller.
    The Contract of Sale shall be deemed concluded upon the Seller’s receipt of the purchase price.
  2. 2. “Goods” means the product called „Darálék” sold by the Seller to the Buyer under the Contract of Sale.
  3. 3. “Seller” means TEXTRADE Kft. (registered seat: 8043 Iszkaszentgyörgy, Városkapu Üzletház, hrsz. 622/1., company registration number: 07-09-013750, tax number: 14119888-2-07).
  4. 4. “Buyer” means any natural or legal person entering into a Contract of Sale with the Seller for the purchase of the Goods.
  5. 5. Composition and Storage of the Goods
  • By paying the purchase price, the Buyer acknowledges and accepts that the Goods are manufactured from recycled materials and may contain up to 1.5% of foreign (non-textile) substances.
  • By paying the purchase price, the Buyer acknowledges and accepts that the Goods consist predominantly of synthetic materials.
  • By paying the purchase price, the Buyer acknowledges and accepts that the Goods shall be stored in a dry, covered area prior to use.
  1. 3. Quality and Quantity Inspection of the Goods
  • By paying the purchase price, the Buyer undertakes to inspect the quality and quantity of the Goods upon delivery.
    Should the Goods fail to comply with the quantity or quality requirements set out in the Contract of Sale or prescribed by applicable law at the time of delivery, the Buyer may exercise its rights arising from such non-conformity within eight (8) calendar days following the inspection.
  • By paying the purchase price, the Buyer acknowledges that the Seller shall bear no liability for any defects or damages in the Goods identified after the expiry of the aforementioned eight (8)-day period, including, without limitation, any damages resulting from the mixing of the Goods with other materials.
  • By paying the purchase price, the Buyer declares that, following the expiry of the eight (8) -day inspection period, it shall have no further claims, demands, or entitlements against the Seller in connection with the Goods supplied under the Contract of Sale, including, but not limited to, any claims for compensation or damages, and that no such claims shall arise in the future.
